By Notice of Motion, dated February 22, 2019, Claimant seeks reconsideration of a Motion for Trial Preference. Claimant's previous request for a trial preference was denied (Oldham v State of New York, UID No. 2017-040-084 [Ct Cl, McCarthy, J., July 7, 2017]).
As Claimant and Defense counsel were advised by letter, dated April 1, 2019, from Brian M. Wilson, Assistant Court Analyst, that the Trial of this wrongful confinement Claim has been scheduled for August 14, 2019 at Clinton Correctional Facility, the Court denies the Motion as moot.
